Occupational Safety & Health (OSHA)
Peckar & Abramson’s Occupational Safety and Health Group helps employers stay ahead of the challenges of maintaining a safe workplace. We advise companies of all sizes on safety and health compliance—whether implementing or strengthening proactive programs, responding to incidents, or managing the federal or state investigations and litigation that can follow.
Experience
Proactive Guidance and Program Development
Every organization approaches safety differently, so we tailor our guidance to each client’s operations. We provide compliance counseling, safety audits and inspections, training, and recordkeeping, as well as integrating safety protocols with broader employment policies and procedures. We help identify vulnerabilities, define management responsibilities, and develop practical, step-by-step response plans for inspections, employee complaints, and whistleblower concerns. We also advise on DOT compliance, drug and alcohol testing programs, and workplace violence prevention, including risk assessments and appropriate protective measures.
Incident Response and Crisis Management
When an incident occurs, timely action is critical. In coordination with our Crisis Management team, we help clients preserve evidence, direct investigations, and manage communications with regulators, insurers, and other stakeholders. An early, disciplined response can reduce OSHA exposure, limit liability for related claims (including workers’ compensation and wrongful death), and protect the company’s reputation.
Government Investigations and Litigation
We regularly represent clients before OSHA, MSHA, Cal/OSHA, and other federal, state, and local agencies in safety matters, including defending against civil and criminal citations, negotiating with agencies and authorities, and defending whistleblower actions and corporate-wide investigations. We have experience with complex, multi-employer, and fatality matters, including proceedings before the Occupational Safety and Health Review Commission (OSHRC). Whether the goal is early resolution or vigorous defense, we focus on practical strategies that achieve the most favorable outcome for each client.
