Full Defense Judgment in High‑Value Condominium Defect Trial

The plaintiff pursued a single negligence claim seeking extensive repair costs for building‑wide issues. After hearing extensive fact and expert testimony, the court entered judgment in the contractor’s favor.
The court held that the Economic Loss Doctrine barred the claim because the plaintiff sought only financial damages, not personal injury or property damage. It further found no special relationship or independent duty between the contractor and the condominium owners that would allow the claim to proceed. The ruling emphasized that responsibility for design, marketing, sales, and building management rested with other project participants and not the contractor.
As a result, no damages were assessed against the contractor, and the court’s substantial compensatory and statutory damages award, totaling more than $356 million, was imposed solely on other parties not represented by P&A.
