Successful Defense Against OSHA Citations

Peckar & Abramson Partner Stephen Irving, with assistance from Associates Tara Munder and Blake Householder, successfully resolved a matter involving contested OSHA citations on behalf of a regional general contractor. After OSHA issued citations to the client alleging violations of the General Duty Clause and the duty to provide sufficient site lighting following a fatal accident, our team was engaged at the litigation stage to challenge the factual and legal bases of the citations. By maintaining a strong, strategic stance during trial preparation and settlement negotiations, the firm ultimately secured a favorable settlement in which the General Duty citation was vacated entirely, and the lighting citation was reduced to a minimal classification (Other-than-Serious), demonstrating that the government could not substantiate its claims.
