$48 Million Plus Award Upheld and $135 Million Claim Defeated in Joint Venture Dispute on Appeal
Published Date: April 24, 2026
Peckar & Abramson has successfully represented Skanska USA Civil Southeast, Inc., one of the nation’s largest general contractors, in a lawsuit against it arising from a joint venture dispute connected to the Florida Department of Transportation’s $2.3 billion I‑4 Ultimate P3 project in Orlando, Florida, the largest project ever undertaken by FDOT.
As previously reported, following a two-week bench trial in the United States District Court for the Middle District of Florida, P&A secured a $48 million award in its client’s favor (plus interest and potentially attorneys’ fees) and the complete denial of the $135 million claim against it, which included allegations of breach of fiduciary duty and gross negligence.
The United States Court of Appeals for the Eleventh Circuit recently affirmed the judgment in its entirety in a published opinion, a resounding victory for the client.
Gary Stein, who served as lead counsel, commented, “Affirmance of the judgment in its entirety validates our client’s position after years of litigation. The court’s ruling underscores the importance of carefully crafted joint-venture agreements and disciplined joint‑venture governance on complex infrastructure projects.”
