Florida Board Certified construction law attorney Jerry P. Brodsky, a partner with national construction law firm Peckar & Abramson P.C. and Director of the firm’s Latin American Practice, has been appointed to The Dispute Resolution Board Foundation’s (DRBF) Region 4 Interim Board of Directors for Latin America. According to the DRBF, the non-profit organization is dedicated to promoting the avoidance and resolution of disputes worldwide using the Dispute Board method.
In recognition of the emergence of Dispute Boards as a preferred dispute resolution process for construction projects in Latin America, and as part of its efforts to develop the Region 4 Board in Latin America for launch in 2022, DRBF’s Executive Board appointed a development team of recognized leaders in Dispute Boards in the Americas. These leaders will serve in the interim role until the Board is duly elected. In this critical role, the Interim Board has been charged with identifying and developing governance policies and procedures focusing on Latin America as well as guidelines and required expertise for future elected Board members.
Trilingual in English, Spanish and Portuguese, Jerry is well-known among peers for his expertise with dispute boards across Latin America and in other jurisdictions. He is actively engaged in training local attorneys throughout the Americas regarding the usage of dispute resolution techniques. In 2016, Jerry was appointed by the Rio Olympic Organizing Committee as Manager/Administrator of its Dispute Board Program related to the construction of non-permanent structures and miscellaneous services. He and his team of construction attorneys created and implemented a dispute board program for approximately 35 service agreements for the construction of non-permanent structures and other services for the Olympic Games.
As Director of Peckar & Abramson’s Latin American Practice, Jerry represents international and domestic general contractors, construction managers, sureties and other construction professionals in the U.S., Latin America and the Caribbean. In addition, he focuses on the negotiation, mediation, arbitration and litigation of construction contract claims, construction and design defect claims, insurance claims, surety bond claims and related matters. Jerry’s practice experience also includes mega-projects for transportation and infrastructure, as well as industrial, commercial and residential engineering and construction projects.
The DRBF’s mission is to promote the avoidance and resolution of disputes worldwide using the unique and proven Dispute Board method. According to the DRBF, the rapid spread of the process worldwide has resulted in it being used on more than $270 billion worth of construction projects, achieving avoidance of numerous disputes and delivering significant savings. The DRBF also states that it provides guidance on effective dispute board implementation tailored for the conditions and practices existing in project areas, as well as training dispute board practitioners and promoting best practices. DRBF Practices and Procedures offers a thorough review of the Dispute Board concept to assist users of the method such as owners, construction managers, architects, engineers, and contractors to employ the process more effectively.
