The presentation will discuss the recently enacted Construction Industry Wage Theft Act which took effect January 4, 2022. This law imposes strict liability upon a contractor for the violations of its subcontractors for wage and benefit underpayments, misclassification of employees as independent contractors and penalties for failure to provide appropriate wage notices at the time of hire and with each paycheck. With this new law, construction industry contractors are expected to increasingly become the target of class action claims brought by their direct employees as well as the employees of their subcontractors.
