Construction delay claims can be intimidating, especially when they involve subpar schedules, numerous events and conditions contributing to delay, competing experts, and thousands of project records. This program is designed as a practical primer for lawyers who are newer to delay issues or who do not regularly encounter them. The presentation will cover the building blocks of a delay claim, including: 1) the difference between excusable, and compensable delays; 2) the concept of critical path and why it drives entitlement to time and money; 3) how concurrent delay, notice provisions, and documentation affect entitlement and recovery; and 4) an overview of generally accepted delay analysis methodologies.
