Levi W. Barrett, a senior associate in the firm’s New York office, authored an article for ConsensusDocs entitled ‘Consent Agreements – A Trap for the Unwary’ which published online in the October 2017 issue. The article describes the purpose of language in a construction contract requiring the contractor to consent to the contract’s assignment to the project’s lender. Barrett cautions contractors to review this language in detail well in advance as savvy lenders may view consent agreements as an opportunity to negotiate a better deal with the contractor.
