Chris M. Sweeney, an associate in the firm’s Washington, DC office, authored a bylined article, entitled “How to Ensure a Successful Inefficiency Claim” which was published in the Fall 2016 DRI Quarterly In-House magazine, the In-House Defense Quarterly. The article discusses inefficiency / lost productivity claims and the common methods of proving the existence of and amount of damages for such claims. Specifically, the article discusses the importance of timely and thorough documentation of construction activities and schedules throughout the project, not just when a problem arises, in order to support an evaluation of productivity and efficiency over the life of the project.
