These panelists will explain that as more New York public owners consider progressive design build (PDB) as an alternative procurement model, contractors must learn to adapt to an open-book preliminary design and early works approach (phase 1) with a switch later to fixed-priced/guaranteed maximum price (GMP) design-build for project execution (phase 2). In this model, owners defer obtaining price, schedule, and performance commitments until after the design has been sufficiently defined, requiring contractors to be open about their pricing with the owner’s independent cost estimator (ICE), and avoiding an “off-ramp” should the owner reject the contractor’s price or other commercial terms.
