Steven M. Charney, Adrian L. Bastianelli, III, Monique S. Cardenas, Melinda S. Gentile, Michael S. Zicherman, Gregory H. Chertoff and Stephen A. Stallings will speak at the 2016 Construction Superconference on December 5 – 7, 2016 at The Encore at Wynn in Las Vegas, Nevada.

Adrian L. Bastianelli, III will be speaking as a panel member in a morning session on Tuesday, December 6^th titled, “Advocacy in Construction Disputes: Construction Failures”.  In this session, the panel members will address among other things, how to address and approach almost every failure, how to best use and how best not to use, experts, special considerations of advocacy in litigation involving injuries or deaths, and how to make issues of structure, geotechnics, thermals dynamics, and hydrology, among others, understandable and persuasive.

Mr. Bastianelli, III will also be a panel member in a morning session on Tuesday, December 6^th titled, “Attorney Advisory: Demonstrating Your Case Through Effective Graphics”.  This panel presentation will explore the use of demonstratives across various forums, sharing insight from attorneys, neutrals, general counsel and subject matter experts. The panel will explore the importance of simplifying complex data with the end-user in mind, as well as various methods for presenting your findings in graphical form. From project visualizations and timelines to damage summaries, attendees will gain an understanding of how to create compelling demonstratives and why they are even more essential in the digital age.

Steven M. Charney will provide introductions and commentary during the lunch and plenary session on Tuesday, December 6^th.  The presentation titled “Talking About Sex – Are Opportunities and Challenges for Women as Construction Lawyers and Consultants Changing?”  Melinda S. Gentile and Monique S. Cardenas will act as moderators during this plenary session.  During this session the panel will discuss the issues women construction lawyers have faced and are continuing to face as well as specific topics pertinent to woman entering these fields today and the perspective of consulting to the construction industry.

Michael S. Zicherman will be participate as a panel member in an afternoon session on Tuesday, December 6^th titled “Physical Security in the Design and Construction of High-Risk Construction Projects”.  The panel members will focus on those aspects of the construction process that are particularly subject to security issues and introduce corresponding legal issues, such as regulatory compliance, contract interpretation, general conditions, scheduling and delay claims, and liability exposure in the event the facility is subject to or is adversely affected by an attack.

Gregory H. Chertoff will moderate and Richard Volack will participate as a panel member in an afternoon session on Tuesday, December 6^th titled ” How ESI Management Helps General Contractors Manage Litigation – Efficiently and Cost-Effectively”.  This panel will define and highlight the state-of-the-art in cost-effectively managing, producing and reviewing Electronically Stored Information (ESI).  Upon completion of this session, participants will be able to: have an understanding of the techniques and approaches that are now being employed to reduce ESI cost, have an understanding of how technology (especially mobile) has evolved and how these changes impact discovery and understand effective management of voluminous amounts of data.

Stephen A. Stallings will moderate a morning session on Wednesday, December 7^th titled “Hitting a Moving Target: Troubles Litigating During a Mega Project”.  This session will present lessons learned from both attorneys and experts on the challenges of litigating during an ongoing construction project. The speakers will cover every facet of the litigation process, from pleading and discovery challenges to expert reports. The presentation will also explore some of the unintended impacts of litigating during an ongoing project by discussing its effect on the project teams, protecting attorney-client privilege, and costs.
