The article discusses the Associated General Contractors of America seeking passage of a bill in 2015 which amends Chapter 558, Florida Statutes, Florida’s “Notice and Opportunity to Cure” statute. The proposed amendments are of significance to those in the construction industry, including general contractors, subcontractors, suppliers, architects, and engineers. The proposed amendments to Chapter 558, as set forth in House Bill 87 and Senate Bill 418, are intended to address a number of problems with the current notice and opportunity to cure process, in order to ensure that recipients of Chapter 558 Notices of Construction Defects can proactively and effectively address alleged construction defects and avoid costly litigation. The proposed legislation has been referred to House and Senate Committees and continues to work its way through the legislative process.
