Kevin J. O’Connor, a partner in the firm’s New Jersey office, will be speaking at the Executive Forum on June 20, 2017 from 5:00 – 7:00pm at The Ayers Group in New York City. Mr. O’Connor’s presentation titled “Misclassification of Workers as Independent Contractors: A Primer, and What We Might Expect to See From the Trump Administration”.
When a company retains the services of a worker and classifies that person as an independent contractor (“IC”), that designation can have significant economic consequences for the participants in that exchange, and it can be challenged. The proliferation of ICs in our society has significantly impacted the worker’s compensation and unemployment insurance markets, and impacted state budgets. At the federal level, the Internal Revenue Service and Department of Labor have launched a “misclassification initiative”; the Equal Employment Opportunity Commission has launched its own initiative; and approximately half the states have passed laws designed to curtail the use of ICs. New York City just enacted a sweeping law that directly relates to this significant topic.
This program provides a primer on the issues, and examines new regulations that have gone into effect in New York City.
