Peckar & Abramson attorneys have experience with all the widely used standard form international contracts whether it’s the EPC/Turnkey contracts of the Federation Internationale des Ingenieurs-Conseils (FIDIC), the Institute of Chemical Engineers’ (IChemE) Green Book for reimbursable projects or some other international standard. The firm also assists clients in developing contracts customized to specific projects or particular client needs as well as in the development of contract packages for subcontracts or purchase orders tailored to international projects.

Despite all efforts, just as with domestic projects, disputes sometimes occur on international projects. International disputes arise in a myriad of forms. Most international projects avoid what can be unfamiliar and unpredictable local court systems and use alternative dispute resolution (ADR) techniques. A Dispute Review Board may be used on a project in Europe; after a mandatory mediation, a project in Thailand may be subject to arbitration under the Singapore International Arbitration Centre rules applying English law; or a Saudi Arabian project may be before the London Court of International Arbitration.

The effective and successful management of international construction disputes is a unique talent. Understanding and appreciation of cultural issues and the ability to navigate the complexities of varied jurisdictions (both legal and procedural) is not a skill that is taught, but rather learned through years of experience. Likewise is the special appreciation for the cultural and legal implications of settlement discussions, mediations and other pre-hearing techniques utilized to resolve disputes.
