To be successful in today’s highly competitive and challenging government marketplace, companies must employ strategies that will reduce risk, result in contract awards and realize timely and profitable performance. This is the reason that many of the most respected domestic and international companies have turned to Peckar & Abramson.
Our government contract attorneys have a long-standing and well recognized expertise in federal, state and local government contracting. We have provided counsel to a wide variety of industries engaged in government contracting, and have represented them in connection with an even broader array of contracting issues and disputes. We have advised Fortune 500 companies, as well as small medium sized companies, engaged in the entire range of government contracting, including defense, aerospace, construction, engineering, information technology, systems integration, transportation and logistics, ship building and repair, maritime and industrial coatings, and project development and finance.
The firm offers its clients a comprehensive catalog of government contracting services, including the identification and development of business opportunities, project development and financing, bid and proposal preparation, contract negotiation and administration, bid protests, claim preparation, litigation of claims and disputes, and advice on contract and regulatory compliance.
As federal regulators and agencies increase their scrutiny of publicly traded companies and government contractors, our corporate integrity and compliance practice has evolved into one of the faster growing segments of our firm. In this minefield of potential liability, we search for any problem areas that could flag regulators, and expertly guide our clients to ensure full compliance with Sarbanes-Oxley, the False Claims Act, the False Statements Act, the Anti-Kickback Act, the Truth in Negotiations Act and other federal laws. We assist our clients in developing compliance programs and in reviewing such programs after they are in place to help our clients avoid claims of mischarging that can arise from the complex and esoteric cost accounting rules that apply to government contracts. If changes to a client’s corporate procedures are necessary, we assist in the development or revision of internal processes to focus on integrity and commitment to compliance. When potential ethics violations surface, we conduct independent investigations and advise our clients about paths forward. Our representation includes assisting our clients in suspension and debarment proceedings.
We are firmly dedicated to the cost-effective and timely resolution of disputes and have an exceptional record of successfully negotiating and mediating government claims and disputes worth hundreds of millions of dollars. However, if litigation becomes necessary, our attorneys have achieved favorable results for our clients before the U.S. Court of Federal Claims, the U.S. Court of Appeals for the Federal Circuit, Boards of Contract Appeals of the various agencies (including the Defense Department, the individual military services, Homeland Security, General Services Administration, Veterans Affairs, Health and Human Services, Education, Agriculture, Corps of Engineers, Postal Service, Federal Aviation Administration and Department of Energy), as well as with state and local governmental agencies and the courts of those states.
Federal Bid Protests
Peckar & Abramson has had unprecedented success in representing our clients in bid protests filed with the Government Accountability Office (“GAO”). Over a three year period, our firm has produced a successful outcome in every protest in which our clients have been parties, in published decisions by the GAO, in voluntary corrective actions undertaken by procuring agencies, and in the defense of contract awards to clients when protests have been filed by other contractors. Our unbroken series of successes has encompassed more than 20 protests. During fiscal year 2011 alone, Peckar & Abramson succeeded on behalf of clients in nine bid protests involving $428 million in contracts.
