Donald Tobin is a partner in the Washington, D.C. office. He has over 30 years experience in litigation and general counseling in both construction and government contracting. He has represented government contractors and construction contractors in the negotiation and preparation of contract and subcontract documents. He has worked with contractors in the preparation and negotiation of requests for equitable adjustment, with an emphasis on the pricing of extra work, delay and inefficiency claims. He has substantial experience in all types of ADR and has settled numerous cases for his clients via mediation.
Mr. Tobin has litigated cases in the local federal courts (including the United States District Court for the District of Columbia and the Court of Federal Claims), state courts in the local jurisdictions (Virginia, Maryland, and the District of Columbia) and other administrative agencies (Armed Services Board of Contract Appeals, General Services Board of Contract Appeals, the Maryland State Board of Contract Appeals and the District of Columbia Board of Contract Appeals). Mr. Tobin has successfully handled complex construction cases before the American Arbitration Association, including a complex, multi-million dollar arbitration on a large combined cycle power plant project in the Midwest. He has also practiced extensively before the Government Accountability Office and the Court of Federal Claims in bid protests. He has represented contractors in defective pricing and fraud investigations. He has assisted small businesses in dealing with the Small Business Administration.
Mr. Tobin is a member of the American Bar Association (Public Contract Law and Litigation Sections, and the Construction Industry Forum). He is a graduate of The College of the Holy Cross (B.A. Mathematics 1969) and Boston College Law School (J.D. 1973 Cum Laude). From 1973 to 1976, he was an attorney with the Office of Counsel, Naval Air Systems Command, specializing in government contracts.
