Mr. Bastianelli has devoted his practice to construction claims and litigation for over thirty-five years, with special emphasis on government construction contract claims. While he represents primarily general contractors, he has represented all aspects of the construction industry including subcontractors, owners, design professionals, and sureties. Mr. Bastianelli is referred to in Chambers USA, Guide to America's Leading Lawyers for Business 2005 as the dean of the Washington, D.C. construction bar.

Mr. Bastianelli has been active in professional organizations, both locally and nationally. He is a fellow and member of the Governing Committee of the American College of Construction Lawyers as well as
the
Chair
of
the
ABA's
Forum on the Construction Industry. Additionally, Mr. Bastianelli is a past President of the Washington Building Congress and is active in the AGC, having written several amicus briefs on its behalf, spoken at its national convention and for its local chapter, and served on its Federal Regulations Committee. Mr. Bastianelli
has
also
chaired
the
Education
Committee
of
the
local
ABC
chapter
and
has
been
active
in
that
organization.
Mr. Bastianelli has written extensively on construction topics. He took the lead role in developing and editing the ABA Forum on the Construction Industryís book entitled Federal Government Construction Contracts, which is the standard in the industry on that subject. For seven years, he served as the Associate Editor or Editor of The Construction Lawyer, the law journal of the ABA Forum on the Construction Industry. He co-authored two chapters for The Construction Claims Deskbook. He developed two manuals for Thomson/West courses on Government regulations affecting the construction industry and differing site conditions. He has written articles for Federal Publications, The Construction Lawyer, and Constructor. Mr. Bastianelli is on the Construction Advisory Council for Thomson/West.
Mr. Bastianelli has spoken on a wide variety of construction topics. He taught the initial sessions for the ABA Forum on the Construction Industryís course on the Fundamentals of Construction Law. He taught numerous courses for Federal Publications on changes and claims; Federal Government regulations that affect the construction industry, privatization, delay and disruption claims, differing site conditions, and practical construction law. He has spoken for the ABA Forum on the construction industry on litigating with the Federal Government; for Lorman Education on the AIA A201 contract and design build; for the Washington Building Congress on the AIA standard form contracts; for the ABC on delay claims, the AIA standard from contracts, recent developments in construction law, and negotiation; for the Maryland State Highway Administration and the Maryland Highway Contractors Association on delay claims; and for AGC national on construction management and liability for latent defects and for its local chapter on selection and retaining of counsel. Additionally, Mr. Bastianelli has spoken at the Construction Superconference.
Mr. Bastianelli has an active ADR practice. He has served as an arbitrator for over twenty-five years. He has served as a mediator on well over
200 disputes, including many involving Federal, State, or local governments. Mr. Bastianelli has served on twelve Dispute Resolution Boards including DRBs for the Central Artery project in Boston, the Greenbush Project in Boston, the Woodrow Wilson Bridge Project in Virginia, and the Dallas Area Rapid Transit Project. He lectures frequently on ADR subjects including presentations to the BCA Judges Association, the DRB Foundation, the Forum on the Construction Industry, the Virginia Bar Association, the Montgomery County Bar Association, and the Maryland State Highway Administration. Additionally, he taught a course on Federal Government ADR for Federal Publications. He has written articles or book chapters on ADR in The Construction Lawyer, The Forum (publication of the DRB Foundation), Federal Government Construction Contracts, and New York Construction Law.
Mr. Bastianelli began his career as a civil engineer with the Corps of Engineers, including four years working on changes and claims in the Louisville District while he attended law school at night. During this time he obtained his professional engineers license in Kentucky. After graduating from law school he served as a law clerk for the U.S. Court of Claims in Washington, DC, now referred to as the U.S. Court of Federal Claims, where he worked exclusively on cases involving Federal Government contract claims. . In 1982, Mr. Bastianelli helped found the law firm that was to become Bastianelli, Brown & Kelley, Chtd., which recently merged with Peckar & Abramson to become Peckar
& Abramson.
Mr. Bastianelli received a Bachelor of Science degree in Civil Engineering from Purdue University in 1966 and a JD from the University of Louisville in 1971.
